This Privacy Policy (“Policy”) has been developed to provide clarity on how Zest Logic-ZLogic OÜ,  a company incorporated in the Republic of Estonia, which registered address: Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551, (“We,” “Us”) collects, processes, stores, and safeguards the Personal Data We obtain about You.

For the purpose of this Policy:

  • The terms “You,” “Your,” “User” refer to any individual or organization using Our Website https://www.zest-logic.com/ 
  • The term “Personal Data” refers to any information that identifies You as a specific individual or can be used to contact or identify You.

By using the Zest Logic Website, You acknowledge that You have read, understood, and agree to the collection, storage, use, and transfer of Your Personal Data as described in this Policy.

Unless otherwise stated, all terms defined in this Privacy Policy have the same meaning as those in the Terms and Conditions and Cookie Policy.


1. INFORMATION WE COLLECT AND HOW WE COLLECT IT

We don’t ask You for Personal Data unless we truly need it. We collect Personal Data to be able to provide You with secure, fast and efficient services. In order to do so, we must collect information to identify Users.

Please note, we collect and process Your Personal Data on the basis of Your consent and legitimate interests. Such collecting and processing of Your Personal Data will not harm any of Your rights and interests, and We will not use Your Personal Data for any other purposes.

We may also collect Your Personal Data that is collected automatically such as through the use of cookies and other technologies as described below in this Policy.

The Personal Data that We collect depends on the context of Your interactions with Us, the choices You make and the services You use. The Personal Data we collect about You may include the following:

a. Contacting forms

When you contact Us via the form on the “Contact Us” pager or/and fill out the form “Tell us about your project”, You voluntarily provide Us with Personal Data. The collection of such information is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and within the limits of applicable US law, including the California Consumer Privacy Act (CCPA/CPRA), if you are a US resident.

In particular, we may collect the following information:

  1. Full name — so that We know how to address You;
  2. Email address — so that We can contact You and respond to Your inquiry;
  3. Your company name (optional) — to understand the context of Your inquiry if it is related to business activities;
  4. Source from which You learned about us — to improve Our communication channels;
  5. Information about Your project or request — which You provide in the text field to describe Your needs, interests, or requests;
  6. Additional information that You voluntarily provide in the text field — to clarify Your requests, needs, or interest in our services.

We process the Personal Data you provide based on Your explicit consent and/or Our legitimate interest — in particular, to respond effectively to Your requests, improve the quality of Our services, and maintain proper communication. We do not use Your Personal Data for any other purposes and do not transfer it to third parties for sale.

We comply with all applicable data protection regulations, including the provisions of the General Data Protection Regulation (GDPR) and the requirements of US privacy legislation, in particular the CCPA/CPRA.

Please note that opting out of marketing communications does not affect the receipt of service or legally required communications that We may send in order to fulfill Our obligations to you (e.g., communications regarding changes to the Terms and Conditions, Privacy Policy, important technical updates, etc.).

We ensure compliance with all applicable Personal Data protection regulations, including:

  • GDPR requirements for obtaining consent and transparency of data processing for residents of the European Economic Area (EEA),
  • CAN-SPAM Act requirements for clearly identifying marketing communications, providing an opt-out option, and complying with other electronic communication standards for US users.


c. Payment data 

When You make a purchase of an extension through the Extension Store, Your payment information is processed exclusively by Stripe, our third-party payment processor. We do not collect, store, or have access to Your full credit card information, such as the card number, CVC code, or expiration date.

All payment details are transmitted directly to Stripe via a secure, encrypted connection. Stripe acts as an independent data controller for the payment transaction and processes Your data in accordance with its own Privacy Policy.

We may receive limited information from Stripe related to your transaction, such as a payment identifier, payment status, date, and confirmation. We use this information solely for the purpose of fulfilling Your order, activating the purchased extension, and maintaining financial records in compliance with applicable legal and tax requirements.

You are not required to create a user account on Our Website to make a purchase. All transactions are one-time and initiated at Your request.

We do not knowingly collect or process payment data from children or offer paid services targeted at minors.

 

d. Profiling

We may carry out limited profiling activities — that is, the automated processing of Personal Data to analyze or predict aspects of Your behavior, preferences, or interests in order to enhance user experience and tailor the content or marketing interactions.

Such profiling may include analyzing technical and behavioral data collected through cookies and similar technologies (see Section d. Cookies and other tracking technologies) and marketing interactions (see Section b. Marketing), such as page views, click paths, session duration, location (based on IP address), device/browser type, and interaction with our emails or advertisements.

Profiling is performed solely to improve Website functionality, personalize communications where You have provided consent, and optimize advertising campaigns via platforms like Meta (Facebook) Pixel.

We do not use profiling to make any decisions that produce legal or similarly significant effects on You. Profiling is only carried out when there is a valid legal basis, such as Your explicit consent or our legitimate interest, in accordance with the General Data Protection Regulation (GDPR) and applicable US laws, including the CCPA/CPRA.

Such processing is carried out in order to ensure effective communication, respond to Your inquiries, evaluate requests for cooperation, improve the quality of service, analyze interest in Our services, and maintain the appropriate level of security for Our Website.

2. HOW WE USE THE INFORMATION 

We collect, store, and process Your Personal Data solely for specific, lawful purposes related to the provision, support, and development of our services in IT consulting, software development, UI/UX design, and e-commerce solution integration.

Affiliates and Acquisitions. Business Partners. We may transfer Your data to Our partner companies, including analytics and marketing services, to ensure integration with e-commerce platforms (ShopifyZro, BigCommerce, WooCommerce) and personalization of communications. This allows Us to jointly improve services, analyze the effectiveness of cooperation, and send relevant offers.

Third Party Service Providers. We may transfer Your Personal Data to third-party service providers with whom We cooperate to ensure the full functioning of Our Website, improve the quality of services, and effectively interact with users. These providers include companies that provide Us with hosting, web analytics, marketing, mailing, customer service, and payment infrastructure services, as well as support integration with e-commerce platforms such as Shopify, WooCommerce, BigCommerce and others. In particular, We may use solutions such as Google Analytics (for traffic analytics), Meta Pixel (for personalized advertising), as well as email distribution services, online chat, and Stripe payment gateways. These providers only get access to Your personal data to the extent necessary to provide the relevant services and are required to use it only in accordance with our instructions and applicable law, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA) if you're a US resident. We do not transfer personal data to third parties for their own marketing purposes and ensure that any data transfer is carried out in accordance with legal requirements, including international data transfer mechanisms, if such transfer takes place outside the European Union or the United States. Other Disclosures without Your Consent. We may disclose Your Personal Data in response to court orders or in connection with any legal process, or to comply with relevant laws. We may also share Your Personal Data in order to establish or exercise our rights, defend against a legal claim, investigate, prevent or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies.

Public. We may provide the opportunity to post comments, feedback or reviews in a public forum. If you decide to submit information on these pages, that information may be publicly available. 

Please note that Your Personal Data is also being processed by Our hosting provider Shopify Inc. All of the Personal Data which is being processed by Us is stored on the territory of the United States and Canada.


4. HOW YOU CAN ACCESS AND CORRECT YOUR PERSONAL DATA

If You wish to access or modify the Personal Data We hold about You, You may send a request to the email address listed in the “Contact Us” section of this Privacy Policy. We will review Your request and may ask You to provide additional information to verify Your identity in order to protect your data. We aim to respond to all requests for access to or correction of Personal Data within 30 (thirty) days, in accordance with applicable law. To the extent permitted by law, You also have the right to request the deletion or restriction of the processing of Your data.


5. HOW WE PROTECT YOUR PERSONAL DATA

We take the security of Your Personal Data seriously. We take all necessary steps to help protect Personal Data that We collect against loss, misuse and unauthorized intrusion and disclosure, and these steps without limitation include encryption techniques and authentication procedures. Zest Logic has been designed to, among other things, meet the objectives of U.S. data privacy laws, as well as the requirements of European Union GDPR. 

We use appropriate technical and organizational security measures to protect Your Personal Data from unauthorized access, disclosure, alteration, or destruction. This includes both data access controls and data encryption during transmission and storage in accordance with industry standards.

However, please note that no system of information transmission over the Internet or method of electronic storage is completely secure. Despite Our efforts, Ee cannot guarantee the complete security of Your data. The transmission of information is at Your own risk.

We are also not responsible for the actions of third parties who may circumvent the technical or organizational security measures implemented on Our Website in the event of unlawful interference or malicious actions.

In case of a data breach, We have a detailed incident response plan to minimize risks and promptly inform affected individuals and authorities.

6. HOW LONG WE KEEP YOUR PERSONAL DATA

 In accordance with the principle of data retention limitation, We store Your Personal Data only for as long as necessary to achieve the purposes set out in this Privacy Policy, or until You ask Us to delete Your Personal Data.

If You want Us to delete the Personal Data We have collected about You, You can submit a request for deletion using the contact information provided in this Policy. We will delete Your Personal Data from our databases within 30 business days of receiving Your request.

We retain Your Personal Data for no longer than three years from the last interaction with Our Website or services. We may also retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (e.g., if required by applicable law), resolve disputes, and protect Our legal rights and policies.

We store anonymized data indefinitely for internal analytical use.

We process Your Personal Data on the basis of Your freely given consent and legitimate interests. You should be aware that You are entitled under EU GDPR to withdraw Your consent where that has been given, at any time. In case You do this, We will have no alternative lawful reason to process Your Personal Data. However, if You ask Us to remove Your Personal Data processed on the basis of legitimate interests, We will not be able to provide You with Zest Logic services anymore.

8. RIGHTS OF CALIFORNIA RESIDENTS 

If You are a California resident, You have the following rights under California Privacy Rights Act - CPRA and CCPA: the right to know the categories of Personal Data that We collect about You, the right to ask Us to delete Your Personal Data from Zest Logic and the right to opt out selling Your Personal Data. 

You can exercise all of the aforementioned rights by sending Us email hi@zest-logic.com, particularly: 

To request information on the Personal Data that We have about You and how We use it: 

  • the categories of Personal Data We have collected about You;
  • the categories of sources from which We collect Your Personal Data;
  • the purpose for collecting, processing or selling Your Personal Data;

  • in case We share Your Personal Data, You can request a list of categories of Personal Data that We have disclosed for business or commercial purpose along with a category of any other company We shared it with.

Please note that You are entitled to ask Us to provide You with this information up to two times in a rolling twelve-month period. You can request it by sending Us email hi@zest-logic.com.

We may require You to confirm Your identity and Your residency in order to obtain the information You email Us with Your request at the contact information below. Please include “California Privacy Rights” as the subject line. You must include your full name, email address and attest to the fact that You are a California resident by including a California postal address in Your request. We will respond to Your request within 45 days or let You know if We need additional time.

When you make this request, the provided information may be limited to the Personal Data We collected about You in the previous 12 months.

 

Right to Delete any of Your Personal Data:

You have the right to request that We delete any of Your Personal Data We collected about You and retained, subject to certain exceptions. 

If You would like to delete Your Personal Data that we process based on our legitimate interests, You may submit a deletion request by contacting Us at hi@zest-logic.com. We will remove all Your Personal Data from our databases within 30 business days after receiving Your request.

 

Right to Correct Inaccurate Personal Data:

You have the right to request that We correct any inaccurate Personal Data We maintain about You. You can submit such a request by emailing Us at hi@zest-logic.com.

 

Sensitive Personal Information:

We do not collect or store any Sensitive Personal Information as defined under the CPRA, including financial data, precise geolocation, login credentials, biometric data, racial or ethnic origin, religious beliefs, or sexual orientation. Therefore, the right to limit the use and disclosure of such information does not apply.

 

Right to Opt Out of Sharing Your Personal Data:

You have the right to opt out of the sharing of Your Personal Data with third parties for cross-context behavioral advertising (targeted advertising). To exercise this right, please send us a request with the subject line "Do Not Share My Personal Information" to hi@zest-logic.com.

 

Non-Discrimination:

We will not discriminate against You for exercising your rights regarding your Personal Data under the California Consumer Privacy Act (as amended by the CPRA). This means We will not deny You goods or services, charge You different prices or rates, or provide you with a different level or quality of services for exercising any of Your rights.

Please note! We do not sell or share Your personal information with third parties as defined under applicable California law, including the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).

If Our practices change in the future, We will update this Privacy Policy in accordance with applicable legal requirements and provide California residents with the opportunity to opt out of the sale or sharing of their personal information via a clearly labeled “Do Not Sell or Share My Personal Information” link on Our Website.

9. RIGHTS OF NEVADA RESIDENTS 

If You are a Nevada resident, You have the following rights under the Nevada Privacy Law: the right to access the Personal Data that We collect about You, the right to ask Us to delete Your Personal Data from Zest Logic, the right to opt out of selling Your Personal Data.

Please note that We do not sell Your personal information in accordance with Nevada law (NRS 603A.340).  

If Our practices change in the future, we will update this Privacy Policy accordingly.

10. RIGHTS OF COLORADO AND VIRGINIA RESIDENTS

  • Deleting Your Personal Data will terminate Your ability to use Zest Logic Services.
  • Upon Your request, We will remove all Your Personal Data from our database within 30 business days unless required to retain it under applicable law.

If any of Your Personal Data is inaccurate, You have the right to request corrections. You may update certain information by sending Us a request via email.
